Florida scoresheet FAQ

How do I calculate a Florida sentencing scoresheet?

Enter the primary offense severity level (1–10), add any additional offenses and prior record, score victim injuries, check legal status or community sanction violations, and apply any enhancements or multipliers. The calculator totals the sentence points and shows the lowest permissible sentence using the formula from § 921.0024, Florida Statutes.

What does '44 points or fewer' mean?

Under § 921.0024(2), Florida Statutes, if total sentence points are equal to or less than 44 points, the lowest permissible sentence is any non-state-prison sanction. The court may generally still impose prison up to the statutory maximum, but at 22 points or fewer, § 775.082(10) may require a non-state-prison sanction for certain third-degree felonies.

What is the lowest permissible sentence formula?

For total sentence points above 44: lowest permissible sentence in months = (total sentence points − 28) × 0.75. At 363 points or more, the court may impose life imprisonment.

Is this calculator accurate?

This calculator implements the point tables and formula from Rule 3.992 and § 921.0024, Florida Statutes. However, offense severity levels change with legislation. Always verify against the version in effect on the offense date and consult a licensed attorney for advice on any specific case.

Can the judge sentence below the scoresheet?

Only with a valid downward departure reason supported by the record, such as those listed in § 921.0026, Florida Statutes. Without one, a sentence below the lowest permissible sentence is reversible error.
